Neumann Update
Neumann Homes has received bankruptcy court approval to complete homes that are under construction. The court has approved that Neumann Homes can work with the lenders - such that they will transfer title of the home to the lenders (banks). The lenders will then work with Neumann and the customer to ensure that the home is completed and fulfill the contracts. The article went on to say that all lenders, with the exception of Bank of America, have agreed to the program. So the remaining homes in VHP should see some activity in the near future.
I haven't gotten any confirmation from anyone at Neumann when exactly things will ramp back up - but this should get the ball rolling.
They haven't posted any updates on what will happen to people still under warranty and/or how things like the fences that need to be painted on "sold" homes will be taken care of. Also there is no mention of anything to do with the concrete issues several people have had. I think these 3 items will likely end up falling back on the homeowners. I think the bankruptcy court will just allow Neumann to complete the homes under construction at this point.

Followup on Newmann Home's bankruptcy
As you may have all heard, Neumann Homes is planning to file for Bankruptcy. They have not done so yet, but likely will in the near term. The BOD is in contact with Jim Niemczyk to get as much information as we can, and will provide it on the MSI website and the community Blog as it becomes known.
At this time, since they haven't even filed for Bankruptcy, there is little we can do, other than wait until they do file, and then find out what the Bankruptcy court is going to allow them to do as far as following through with home warranties and completing homes under construction.
All the remaining homes at VHP went under contract during the auction in October. They were all sold with a condition of having an Certificate of Occupancy. We have been told by Jim Niemczyk of Neumann Homes that Neumann has every intention of completing these homes so they can close on them, but at this moment a completion date has not been set. The Board does feel that it's highly likely that Neumann will complete these homes so that a profit can be realized and distributed to creditors. However, there is risk that this process may be drawn out, pending court proceedings. The homes at the auction were sold "as-is" so homeowners will not get a 1 year home warranty. The BOD will continue to work with Neumann Homes to try to get a closing date for these homes.

All warranty personnel in Colorado have been let go so all coordination will take place via Matt.
We have been working with Neumann Homes on the homes with concrete problems, especially in drive-ways. That work was delayed several times by Neumann and at this point we do not believe that Neumann will fix these issues. It will likely fall back to the homeowners. We will continue to follow through with Neumann to see what will happen here, but unless the bankruptcy court allows the expenditure, we doubt that anything will be done.
One the plus side, most of the homes in VHP have either completed their warranty period, or at least had the 30 day warranty coverage. Also all of the common areas (Pool, Clubhouse, Landscaping, etc.) have all been completed for over 1 year now so the warranty work was finished in those areas. The HOA will not be stuck with trying to finish out these areas.
At this time we are not planning an emergency HOA meeting. Until Neumann actually files for Bankruptcy and has their first court appearance with their initial plan on what to do, there is very little that we can do. Once the bankruptcy court goes through their plan we should then at least have some preliminary guidelines of what will and won't be allowed to be completed by the court and then we would be able to have a discussion on our options.
Our next homeowners meeting is scheduled for January. This may actually take place before we have any firm direction from the bankruptcy court, so having a meeting prior to that will not be very productive.

VHP FALL Festival

Hello VHP residents,
The Social Committee is planning a Fall Festival on Sunday, Oct 14 from 1-4 and needs your help!
Since we are on a very limited budget (1/3 of the 4th of July party) we would like some help from the residents to make this 1st Annual Fall festival a success. We are in need of a very large tent with sides (maybe from your church or work)in case of cold weather or rain or a few small ones to put side by side, some sort of entertainment (hay rides, band, pony rides, petting zoo, or other), bouncy, and any type of carnival activities.
If you know someone or you can help in any manner, please email me back. We know places to rent these things from but are hoping the residents of The Village at Harmony Park may have connections. Also, please forward this to any other resident that may not be on the email list.

Radon levels in Harmony Park
This is an email from one of our neighbors. You should probably check your levels.
Road Conditions
Neumann Homes is working to have Westminster accept the roads from our development and has recently replaced some concrete curbing and patched the blacktop, mostly to cut down on standing water. The blacktop patching is terrible and water continues to accumulate around the patches. The main through street, Harmony Parkway, is so bumpy it is like riding a roller coaster.
Westminster needs to inspect and refuse the current condition of the roads in Harmony Park. Please do not accept the roads from Neumann homes until they regrade and repave the roads.
